Terms And Conditions

1. Definitions & General Terms

  • "We," "us," or "the company" refers to Get My Drive.
  • "You" or "the hirer" refers to the customer renting the vehicle.
  • Both parties agree to comply with applicable laws and regulations.
  • Payment structures include security deposits, refundable under specified conditions.
  • The hirer must be at least 21 years old and hold a valid driving license for a minimum period of one year.
  • By renting a vehicle, the hirer agrees to abide by these terms and conditions and accept financial responsibility for any violations.

2. Vehicle Use & Restrictions

  • The hirer must use the vehicle responsibly and adhere to all traffic laws.
  • Unauthorized activities, including hazardous material transport, intoxicated driving, commercial use, or illegal activities, are strictly prohibited.
  • The vehicle must not be used for racing, off-road driving, or towing.
  • Any modification, alteration, or tampering with the vehicle is strictly forbidden.
  • Penalties apply for speeding, traffic violations, and vehicle misuse.
  • In case of an accident or mechanical failure, the hirer must immediately inform Get My Drive and follow the necessary procedures.

3. Vehicle Return & Damage

  • The vehicle must be returned at the agreed location and time.
  • Late returns, unauthorized drop-offs, and vehicle damage (including tires, accessories, and interiors) will incur penalties.
  • The hirer is responsible for repair and replacement costs for damages.
  • The vehicle must be returned in a clean condition. A cleaning fee may apply for excessive dirt, stains, or smoking inside the vehicle.
  • Any loss of keys or vehicle documents will result in additional charges.

4. Liabilities & Penalties

  • Specific penalties apply for non-compliance, such as smoking inside the vehicle or tampering with installed devices.
  • Cancellation fees and charges for fuel discrepancies will be enforced.
  • Traffic fines incurred during the rental period will be charged to the hirer.
  • The company reserves the right to terminate the rental agreement without notice if the hirer breaches any terms.

5. Insurance & Protection

  • Get My Drive provides specified insurance coverage; the hirer remains liable for damages not covered.
  • Insurance deductibles apply, and severe damage may result in forfeiting the security deposit.
  • The hirer is responsible for ensuring proper use of the vehicle to prevent insurance claims from being voided.
  • Theft or loss of personal belongings is not covered under company insurance.
  • Any third-party liability beyond the coverage limits will be the hirer's responsibility.

6. Cancellation & Early Termination

  • The contract termination policy includes financial consequences and penalties for early return.
  • Cancellations made less than 24 hours before the booking will incur a cancellation fee.
  • No refunds will be provided for early returns unless explicitly agreed upon.

7. Force Majeure & Legal Framework

  • Neither party is liable for circumstances beyond their control (e.g., natural disasters, strikes).
  • Arbitration is the preferred method for dispute resolution, under the governing law of Chennai, Tamil Nadu, India.
  • Any legal proceedings related to the rental must be conducted within the jurisdiction of Chennai.
